Why Should You Attend:

The Food Safety Modernization Act (FSMA) enforces numerous new mandates and rules that impact all the entities in the farm-to-fork chain including - food manufacturing, processing, packaging, transporting, warehousing, distribution, and retail. This update further broadens FDA's authority to regulate facilities that handle food and establishes and enforces additional compliance requirements. Even though FSMA's requirements will be implemented and adopted in over three years, organizations need to adopt a proactive and structured approach to ensure that they are able to comply with all the current and future requirements. While some requirements are already in effect, others are pending or still being formulated for later implementation.

One of the important updates is on FDA Fees - As per Section 107 - FDA has the authority to impose fees on a limited number of FDA services/functions such as recalls, re-inspections, and export certifications. Some of these fees are already being included in warning letters issued this spring. Other FSMA's mandates include Section 206 - FDA's new mandatory recall authority, Section 301 - new import requirements that enforce food companies to increase due diligence on imported food, Section 202 - extended food testing requirements, Section 103 - updated Hazard Analysis and Critical Control Point (HACCP) programs, and Section 204 - other requirements to supplement food tracking recordkeeping.

Marc C. Sanchez, Founder and Principal, Contract In-House Counsel and Consultants, LLC. Mr. Sanchez practices medical device and food law. He is best known for working to build regulatory strategies for start-ups and small to midsize companies in the US, Europe, and China. For food producers, Mr. Sanchez's practice includes working with both the FDA and USDA on compliance, recalls, and import matters. He is also a leading voice in understanding the Food Safety Modernization Act, which has fundamentally changed food law in the U.S. Marc's strategy is to develop smart corporate governance along with regulatory compliance. Mr. Sanchez began his career with the legal division at Nike's European Headquarters. There he headed up product recalls, pricing, and digital privacy in the EU, US, China, and Japan. After Nike, he began his own practice in Seattle focusing on product recalls, regulatory compliance, and employment law with an emphasis on social media and digital privacy. In 2011, opportunities in the Atlanta and the national market lead Marc to found Contract In-House Counsel and Consultants, LLC to offer a broad range of services to the medical device and food industry. He currently serves clients across the US, EU, China, and Middle East.

Keri Dawson, Vice President of ComplianceOnline Advisory Services, MetricStream.
