This healthcare compliance training will explain how to organize and negotiate physician financial arrangements in order to be ready for internal and external audits. Attendees will learn how to comply with regulatory requirements of Stark Law, the Anti-kickback statute, the False Claims Act (FCA), and IRS tax-exemption code related to physician arrangements.

Why Should You Attend:

Financial arrangements that exist between physicians and healthcare providers (e.g., hospitals) to which they refer patients have been the focus of Office of Inspector General and other regulatory agencies for quite some time. The extent of such arrangements between physicians and healthcare providers impact utilization of services, quality of care, medical necessity, cost and pricing and competitiveness. As organizations continue to negotiate financial relationships with physicians, organizing and streamlining the executed contracts should be a priority to demonstrate the organization’s commitment to mitigating risk and complying with Stark Law, the Anti-kickback statute, the False Claims Act (FCA), and IRS tax-exemption code.

This webinar has a legal and regulatory focus and will assist the attendees in understanding effortless ways to bring all the physician financial arrangements (e.g., medical director and professional services/on-call agreements, space and equipment leases, employment agreements, management agreements, physician practice acquisitions, and other arrangements) together into a centralized location. Simple examples will be shared as guidance for attendees to maintain supporting documentation such as fair market value (FMV) and commercial reasonableness with the executed agreements as well as how to validate key terms are documented within the executed arrangement.

Areas Covered in the Webinar:

  • Present a framework of designing a contract management system
  • Defining the regulatory requirements (e.g., Stark, Anti-Kickback and False Claims Act) related to physician arrangements

    • Review a sample checklist to assist with auditing and monitoring contract files
    • Present sample internal reporting to management or the governing board
    • Review the criteria to manage various physician financial arrangements (e.g., employed and medical directorship) and supporting documentation such as FMV and commercial reasonableness into a central location
    • Learn how to determine if key agreement terms are included in the contracts to meet regulatory expectations
