There has been an increasing focus on "conflict minerals" or "3TG" (tin, tantalum, tungsten, or gold) emanating from the mining operations in the Democratic Republic of the Congo (DRC) and adjoining countries. On August 22, 2012, the U.S. Securities and Exchange Commission (SEC) issued final rules for compliance with Section 1502 of the Dodd-Frank Act , and outlined what publicly traded companies in the U.S have to disclose regarding their use of conflict minerals in their products, primarily whether it originates in or near the Democratic Republic of the Congo (DRC). The rule affects many product categories including: Retail, Electronics, Appliances, Lighting, Automotive, Energy, Food, Medical devices, Aerospace, Jewelry and Other consumer goods.

According to the rule, companies that utilize any of the 3TG minerals need to conduct a reasonable 'country of origin' inquiry (RCOI) to determine whether any of the minerals originated in the covered countries or are from scrap or recycled sources. If minerals did not originate in the DRC or covered countries or are from scrap or recycled sources, then the companies must reveal their determination; provide descriptions of inquiries undertaken and the results on Form SD.

If originated from DRC or other covered countries, then organizations need to conduct a due diligence on the source and chain of custody, Suppliers, Smelters / Refiners, identify risks and adopt strategies for risk mitigation, utilize independent auditors to audit and certify, create a conflict minerals report and disclose the details in public website.

Lawrence M. Heim, CPEA - Director, The Elm Consulting Group International LLC. Mr. Heim is a BEAC-Certified Professional Environmental Auditor (CPEA) with more than 27 years of experience conducting more than 500 environmental compliance audits/assessments globally. He began working in the conflict minerals area in 2010 as one of the original three audit firms for the EICC/GeSI Conflict Free Smelter (CFS) program. Since then, he has been providing program advisory support to clients and trade associations on conflict minerals programs and was the only consultant selected by the US Securities and Exchange Commission as an expert panelist on HSES auditing in their October 2011 Conflict Minerals Roundtable. He is currently working with a number of clients on the strategy, design and implementation of their programs and is a frequent speaker on the topic.
