Employers have long struggled with their legal obligations when an employee's illness or injury triggers possible rights under the ADA, the FMLA, and state workers' compensation laws.

The difficulty in complying with these laws has become more complicated – Congress expanded the ADA to ensure broader coverage.  Congress passed GINA prohibiting what an employer might ask when seeking medical information to comply with the ADA or the FMLA.

And, the ultimate question, when can you terminate because the employee has just been on leave for too long?  What benefits must you offer?
