Family and Medical Leave Act (FMLA)

Family and Medical Leave Act (FMLA) is an American labor law – and the most prominent among US employee leave laws – that requires the covered employers to provide eligible employees up to 12 weeks of unpaid leave in a 12 month period for certain specific family and medical reasons. The Wage and Hour Division of the US Department of Labor administers this law.

  • Covered employers are private employers with 50 or more employees or governmental employers of any size. Government agencies of any size have to comply with the law as well.
  • FMLA eligible employees are those who worked at least 12 months for the employer and who worked at least 1250 hours in the 12 month prior to the qualifying event.

Both eligible employers and employees can avail various benefits under the FMLA.
