California Family Rights Act (CFRA) Eligibility


California Leaves of Absence


Employers who meet the following requirements have to comply with the California Family Rights Act (CFRA) :

  • He/ she must employ 50 or more part time or full time employees
  • Must be a non-profit organization running in California

CFRA eligibility requirement for employee:

  • He/ she must be a part time or full time employee working in California
  • Must have more than 12 months (52 weeks) of service with the employer
  • Must have worked at least 1,250 hours in the 12-month period prior to the date the leave begins.

The California Family Rights Act has very specific criteria for calculating leave as well as duration and notification requirements. According to the CFRA, a serious health condition may include an injury or illness to not just the employee, but a spouse, child or parent as well. The Act also provides multiple benefits for both eligible employees as well as employers.
